The majorities of divorces cases are not contested and below is an outline of the procedure involved:
THE DIVORCE PROCESS
The Petition is drafted and lodged with the papers at the County Court and then the acknowledgement of service is then posted by the Court to the Respondent.
The current issue fee to lodge the Petition is £300.00
The Respondent must acknowledge the Petition within 8 days
The Respondent must file an answer within 29 days if the proceedings are defended
If undefended the Petitioner files an affidavit in support of the petition and applies to the Court for the Decree Nisi. There is a charge of £7 to swear the affidavit on oath in front of a solicitor or commissioner for oaths unless you attend the County Court where the service is provided without any cost to you.
The Court will consider the documentation filed and decide whether the parties are entitled to a divorce if satisfied the parties are notified of the date when the Decree Nisi is pronounced. There is know need for attendance at the court when the Decree Nisi is pronounced.
If the Court is satisfied with the arrangements regarding any children involved the matter can proceed six weeks from the date the Decree Nisi was pronounced to Decree Absolute. The application is normally processed within 24hours and costs £40.00 this formally dissolves the marriage.
If the Petitioner does not apply for the Decree Absolute the Respondent can do so three months from the date of the Decree Nisi.
