Applying to the Court
The vast majority of cases are settled without having to apply to the court. However when it does become necessary the following procedure is used:
Either party can issue an application at Court which is the served by the Court on the other party.
The Court then notifies the parties when the first hearing will take place and makes directions regarding what steps must be taken by the parties.
At the first directions appointment the Judge considers the case and ascertains whether any progress can be made. The Judge will make further directions regarding the filing of statements or further information requested.
At the Financial Dispute Resolution hearing the parties have the opportunity of trying to resolve matters by consent and if agreement is reached an order can be made. If no agreement is reached at this stage the matter will be listed for a final hearing.
