Sometimes on the breakdown of a relationship the parties concerned may wish to separate and finalize matters relating to the children, housing etc without commencing divorce proceedings. People separate for a number of reasons most commonly because the parties have agreed to wait two years before commencing divorce proceedings or in situations where they have not been married for at least one year.

In such situations the parties can negotiate a Separation Agreement which deals with such matters as the children, the matrimonial home and matrimonial assets. This can then be incorporated into a Consent Order when the divorce takes place and takes a great deal of acrimony out of the situation.

It is very important that before any separation agreement is prepared that the parties give full financial disclosure of their assets including any Pension, Savings, Capital and Investments. This ensures that the parties are in full possession of the facts before agreeing any settlement.

It is essential that both parties to a Separation Agreement receive independent legal advice.
