Train Driver granted leave to appeal against 1990 conviction

The Court of Appeal today granted M leave to appeal against his conviction for Manslaughter following the Purley Rail Crash in 1989.

M had pleaded guilty at the time but leave to appeal was sought on the basis that new evidence showed the conviction to be unsafe.

Gary Rubin of Andrews Angel stated:

“Our client is delighted to have been granted leave to appeal his conviction, especially after the time that has elapsed. There is now however much hard work to be done to prepare for the appeal hearing.”

The full appeal is anticipated to be heard in late 2007.
